Website terms
Terms of Use
The rules for using our website, instant-estimate tool, lighting designer, and installation-request form.
The important points
- An instant estimate is a planning estimate, not a binding bid.
- Submitting an installation request does not reserve a date or create a service contract.
- A booking exists only after Sparkle confirms availability and both sides accept the final written scope and price.
- Any signed proposal or service agreement controls the actual installation work.
1. Acceptance of these Terms
These Terms of Use (“Terms”) govern your use of sparklechristmaslights.com and its quote, design, and installation-request features (collectively, the “Site”). The Site is operated by Sparkle Christmas Lights (“Sparkle,” “we,” “us,” or “our”).
By using the Site or submitting a form, you agree to these Terms and acknowledge our
The Site provides information about professional seasonal Christmas-light services and allows users to request a planning estimate, choose possible design elements, and request a preferred installation date. Website content is general information. It is not architectural, engineering, electrical, structural, legal, insurance, or safety advice. Property conditions vary, and the actual service scope must be reviewed for the specific property.2. Website purpose
3. Eligibility and authority
You may submit a quote or installation request only if you are at least 18 years old and legally able to enter an agreement. By requesting work for a property, you represent that you own the property or have the owner’s or authorized manager’s permission to request and approve the work.
You may not use the Site to impersonate another person, submit a request for a property without authorization, or interfere with another person’s account, inquiry, or service relationship.
4. Instant estimates are planning estimates
An estimate displayed by the Site is generated from the information and design selections entered by the user and the pricing logic then available on the Site. It is intended to help with initial planning only.
An instant estimate is not a binding quote, guaranteed price, offer, contract, invoice, or promise that a project can be completed for that amount. The final price and scope may change after reviewing photographs, measurements, rooflines, access, electrical availability, trees and landscaping, mounting conditions, safety conditions, requested materials, service area, timing, or other site-specific facts.
Obvious typographical, calculation, programming, or display errors do not bind Sparkle. If we identify an error, we may correct it and provide an updated estimate or written quote before any agreement is formed.
5. Installation requests are not confirmed bookings
Submitting an installation request:
- creates a request for Sparkle to review;
- does not guarantee availability, a particular date or time, a particular design, or acceptance of the project;
- does not place the requested date on hold unless Sparkle expressly confirms that in writing; and
- does not create an obligation for you to purchase or for Sparkle to provide services.
A date is booked only after Sparkle expressly confirms it and any required written proposal, approval, deposit, or other booking step has been completed.
6. The final written service agreement controls
Before installation, Sparkle may provide a written quote, proposal, invoice, work order, or service agreement describing the final scope, price, payment terms, materials, maintenance, takedown, storage, cancellation or rescheduling rules, property-access requirements, and other project terms.
Those project-specific terms control the actual services. If a project-specific written agreement conflicts with these website Terms, the project-specific agreement controls for that project.
No website statement changes a signed service agreement unless Sparkle confirms the change in writing.
7. Your responsibilities
You agree to:
- provide current, accurate, and complete contact, property, design, address, access, and scheduling information;
- correct information that becomes inaccurate before Sparkle relies on it;
- disclose known hazards or special conditions that could affect access or safe work, including fragile surfaces, concealed damage, unusual electrical conditions, restricted areas, animals, gates, roof concerns, or nearby utilities;
- obtain any owner, landlord, homeowners-association, property-manager, or other approval required for the requested work; and
- avoid placing passwords, payment-card numbers, government-identification numbers, medical information, or other sensitive information in a general notes field.
Sparkle may rely on the information you provide when preparing an estimate or deciding whether and how to perform work.
8. Scheduling, weather, access, and safety
Seasonal outdoor work depends on weather, daylight, property access, crew availability, equipment, materials, site conditions, and safe working conditions. Sparkle may reschedule, pause, modify, or decline work when reasonably necessary for safety, weather, access, property protection, staffing, material availability, or circumstances outside our reasonable control.
Requested dates and times are preferences unless expressly confirmed. Arrival and completion windows may change. Project-specific remedies, credits, cancellation rights, or rescheduling terms—if any—will be stated in the final written service agreement.
9. Communications about your request
When you provide an email address or phone number and submit a form, you authorize Sparkle to contact you by email, phone call, or text message about that inquiry, quote, installation request, scheduling, service, maintenance, takedown, storage, or payment.
Submitting a service form does not by itself enroll you in recurring automated promotional text messages. Any separate marketing program will provide its own disclosures and choices. Message and data rates may apply to text messages.
You are responsible for ensuring that the contact information belongs to you or that you have permission to provide it.
10. Acceptable use
You may use the Site only for lawful personal or business purposes related to evaluating or requesting Sparkle’s services. You may not:
- submit false, fraudulent, harassing, unlawful, or misleading information;
- attempt to gain unauthorized access to the Site, server, database, forms, customer records, or administrative functions;
- probe, scan, disable, overload, scrape, or interfere with the Site or its security;
- introduce malware, malicious code, automated spam, or destructive content;
- copy or use Site content to impersonate Sparkle or mislead consumers; or
- use the Site in a way that violates another person’s rights or applicable law.
We may restrict access, reject submissions, or take other reasonable action if we believe the Site is being misused.
11. Intellectual property
The Site’s original text, branding, logo, layout, graphics, code, quote-builder presentation, illustrations, photographs owned by Sparkle, and other original content are owned by Sparkle or used with permission and are protected by applicable intellectual-property laws.
You may view and print a reasonable copy for your own evaluation of Sparkle’s services. You may not reproduce, publish, sell, license, distribute, remove ownership notices from, or create a competing or misleading derivative of Site content without written permission.
Information you submit remains yours. You grant Sparkle a limited, nonexclusive right to host, copy, process, and use that information as reasonably necessary to operate the Site, respond to the request, prepare a quote, provide requested services, keep business records, and comply with law.
12. Third-party services and links
The Site may depend on or link to third-party hosting, maps, analytics, advertising, email, scheduling, payment, social-media, or other services. Third-party services are governed by their own terms and privacy policies. Sparkle does not control and is not responsible for a third party’s independent content, availability, or practices.
A link does not necessarily mean Sparkle endorses every statement, product, or service offered by that third party.
13. Website disclaimers
To the fullest extent permitted by law, the Site is provided on an “as is” and “as available” basis. Sparkle does not warrant that the Site will always be uninterrupted, error-free, secure, current, or compatible with every device or browser.
Images, interactive previews, color renderings, bulb spacing, house illustrations, design summaries, and displayed examples are illustrative. Actual colors, dimensions, visibility, placement, materials, and finished appearance may vary because of screens, photography, property conditions, available materials, safety requirements, and final approved scope.
Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded. Warranties concerning actual installation services, if any, will be stated in the final written service agreement.
14. Limitation of liability for Site use
To the fullest extent permitted by law, Sparkle will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of—or inability to use—the Site, including loss of data, opportunity, revenue, or anticipated savings.
To the fullest extent permitted by law, Sparkle’s aggregate liability arising solely from use of the Site will not exceed $100.
This section does not limit liability that cannot legally be limited, and it does not replace or control liability terms in a separately accepted service agreement governing actual work at a property.
15. Governing law and venue
These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law rules. Unless applicable law requires otherwise, a dispute arising solely from these Terms or use of the Site must be brought in a state or federal court located in Multnomah County, Oregon, and the parties consent to that court’s jurisdiction.
This provision does not waive any nonwaivable consumer right or legally required venue available to you.
16. Changes and general terms
We may update these Terms when the Site, services, or legal requirements change. Updated Terms will be posted on this page with a revised “Last updated” date. Changes apply prospectively from the stated effective date unless applicable law requires otherwise.
If a provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. Section headings are for convenience only.
These Terms, together with the Privacy Policy, form the agreement governing use of the Site. A separately accepted written service agreement governs actual installation services.
